How To See Whether Someone Is Married or Divorced in Ada County

Ada County public records–including marriage certificates and public divorce records–can be obtained through several custodians, but each has a different process and cost associated. Interested parties should also note that Idaho marriage and divorce records are withheld by law for 50 years after finalization.

You can obtain Ada County divorce records or request marriage records by filling out a Public Record Request Form online or inquiring with the Ada County Recorder in person. Copies cost $1 each, with an extra $1 per document if certification is needed.

Another method of obtaining copies of marriage and divorce records in Ada County is by turning in a General Record Request Form to the Recorder’s office along with a $2 payment per copy by cash or check. Requesters will need to know the full names (and ideally maiden names) of the subjects of the record and the year the marriage occurred.

In the state of Idaho, marriage and divorce certificates from May 1947 on can also be ordered through the Idaho Bureau of Vital Records (IVR) of the State’s Department of Health and Welfare, but only the person(s) named on the certificate, immediate members of the family, legal representatives, or others who have a court order may purchase them if they are less than 50 years old.6

How To Look Up Someone’s Criminal History in Ada County Idaho

Public records in Ada County that are made available by the Idaho Public Records Law include criminal history information consisting of details from arrest records, police reports, law enforcement agencies, and correctional facilities.

Criminal records are far more in-depth than arrest or jail records, as they provide a comprehensive look into a subject’s past and pending criminal details and case proceedings rather than focusing on one incident.

Ada County criminal records are obtainable through various custodians, but not all can provide certified records. The Ada County Clerk of Court can look up someone’s criminal record and may be reached at the location or phone number listed above for criminal history inquiries.7 Searchers who prefer an electronic search can conduct one by requesting a criminal case search or utilizing the iCourt Portal.

Law enforcement agencies such as the Boise Police Department and Ada County Sheriff’s Office can also provide insight into previous arrests, detainments, and offenses via public records requests.2 Though most requesters can receive a free criminal record check this way, large requests through either of these agencies will be charged a fee.

Obtain Ada County Criminal Records via State Record Custodians (Idaho)

City and county custodians can provide relevant criminal history information, but the best option for securing a comprehensive criminal record is through the state’s central public records repository–the Bureau of Criminal Identification (BCI) of the Idaho State Police (ISP).8

Idaho criminal records are available to the public via the BCI’s name-based background checks for a cost of $20, but requesters may benefit from knowing that the name-based search may not be completely accurate, as mistakes due to misspellings, aliases, or duplicate names are possible.9, 10 Any individual may use this form to search for others’ criminal history information by name.

While a more reliable search is available by way of a fingerprint-based background check and is available for public use, it could be difficult to obtain fingerprints of another subject, so this type of criminal record is often obtained for oneself.11 This type of record costs the same as a name-based check ($20) but necessitates that a standard fingerprint card be completed and submitted along with the form and payment (by check or credit card).

The BCI charges $10 for the initial fingerprint card and $5 per additional card needed (separate from the criminal background check fee).

Individuals may also want to check if someone has a criminal record through the IDOC’s Resident/Client Search, where current inmates and those released under supervision can be found along with their offense and sentencing details and case information for free. The search tool allows for searches by either last name or IDOC number, and results will be limited to the state of Idaho.

How Do I Perform a Background Check in Ada County?

Idaho background checks can help provide insight into an individual’s history, often including a wide range of information from employment and residency to criminal history and past or pending court cases.9

Background checks can be done for either personal or professional reasons, but the purpose of the investigation dictates how the check can be conducted.

Personal background checks can help an interested party look into a family member, coworker, or neighbor without the subject’s knowledge or consent, as Idaho state law does not require it. However, the information found in the background check cannot be used to stalk, harass, or otherwise harm or intimidate the subject. Third-party platforms can provide efficient and helpful results for a small fee.

Professional background checks are often used for employment, purchasing firearms, housing, and other official purposes. These require consent from the person being investigated, and the subject maintains the right to dispute false information produced from the background check.

Professional checks must adhere to the laws enforced by the Equal Employment Opportunity Commission (EEOC) and Fair Credit Reporting Act (FCRA) to protect applicants, trainees, and employees from discrimination and ensure fair and accurate consumer reporting.

Note: There are two primary types of professional background checks–Level 1 and Level 2.

Level 1 background checks are name-based and have a greater margin of error, but Level 2 background checks rely on fingerprint matches and are highly accurate and reliable.

These records can hold information gathered from police records, courts, probation and parole offices, detention centers, and law enforcement agencies. However, Level 2 background checks are extremely thorough and often include in-depth details such as one’s marital status, prior and current employers, addresses, education, and more.

While both Level 1 and 2 background checks can be used for employment reasons, Level 2 checks are usually reserved for jobs working with young children, the elderly, the process of adoption, and some C-level positions.

Although Ada County and its major cities do not offer background checks, both Level 1 name-based background checks and Level 2 fingerprint-based background checks are accessible via the BCI, and the processes for obtaining each are explained in detail in the previous section.10, 11

Level 2 checks do not have to go through an authorized agency to be reviewed by the BCI; instead, any individual can submit their own or someone else’s fingerprints and the appropriate completed form with a payment of $20 to have a background check conducted.

Payments to the BCI can be made by credit card or check, but fingerprints taken either at the BCI or other law enforcement agencies will come at a separate and additional cost. As an exception, the Idaho Department of Health & Welfare requires individuals who apply to work for the department to undergo a more thorough background check.

How To Search for Active Arrest Warrants in Ada County (Check Who’s Wanted)

Interested parties can check if someone has a warrant in Ada County, Idaho, through several options at the local and state levels.

At the local level, individuals can search for Ada County Sheriff’s Office warrants by first or last name and will be shown subjects who have valid arrest warrants in the county for criminal or traffic offenses.16 Juvenile offenders will not be shown in the search results.

The Ada County Clerk of Court will also be able to provide information about outstanding Ada County warrants, but the sheriff’s office or online search should be utilized first.7

A statewide warrant search may also be performed through the Idaho Department of Corrections (IDOC) Resident/Client Search, but these will only show warrant information on offenders who are already incarcerated and being held in IDOC custody. IDOC inmates may be searched via this free service by last name or IDOC number.

How To Figure Out If Someone Is on Probation in Ada County Idaho

A search of individuals who have been released from jail and are on court-ordered supervision or probation in Ada County can be performed on either a county- or statewide scale.

At the local level, the Ada County Sheriff’s Office (ASCO) is tasked with supervising misdemeanor probation clients.2, 18 Although there isn’t an online directory of probationers, the parole office can be contacted by phone or in person for inquiries.

How To Track Down Court Records in Ada County ID

The Idaho Court System is composed of 3 levels–the Supreme Court, the Court of Appeals, and the District–or Trial–Courts (which include the Division of the Magistrate).

A low-cost or free public records search is available at all court levels in the state but via differing means. The process of obtaining court records through each type of court is summarized below.

Ada County judicial records are open for public viewing unless legally withheld or sealed. Individuals hoping to access Ada County court records can do so in person at the local courthouse–one of four courthouses of the Fourth Judicial Court.21

A public index of trial court records, including probate cases, is also available online via iCourt. Court dates, hearing calendars, and court documents are all available via the portal as well. To conduct an Ada County case search, simply select “Ada” from the county dropdown menu and “Records Search” under the service dropdown.

Searchers will then be brought to the iCourt Portal Smart Search feature, where court records can be found by case number or name (typed in order of last, first, middle, and suffix). Sealed and juvenile records are not available, but all public court records can be viewed electronically with this search tool. Copies of court records come at a nominal fee, variable by record type and number of copies.

Charges paid by credit card are subject to a 3.5% transaction fee.

If any particular Ada County public records pertaining to court cases cannot be found via the aforementioned methods, a court record request may be submitted online.

Requesters can simply select the relevant request type and enter their name, contact information, and information on the record they’d like. Individuals may also opt to have their court records certified.

How To Initiate a Vital Records Search in Ada County: Retrieve Birth & Death Certificates

Ada County public records extend to certificates of birth and death as well as other vital records, but certified copies are only available under certain circumstances.

In Idaho, certificates of birth are made confidential by law for 100 years, while certificates of death are confidential for 50 years; copies of birth records can be requested from the Ada County Clerk for $1 for each page plus $1 per document certification.

However, since state law prohibits certificates of death from being issued at the county level by the coroner’s office, death records should instead be obtained directly from the funeral home involved or through the methods outlined below.

After the required waiting period, either type of vital record can be ordered by mail from the Idaho Bureau of Vital Records (IVR) of the Department of Health & Welfare as long as the event occurred after July 1911.23
